Grogin, Mr Fair, on behalf of Young, urged that Mr Thomas’ argument was fallacious, ~ for lie had been speaking as to the popular meaning of tho word “totalisator” and had forgotten that what the court had to decide was the meaning of the word as defined in 1908. So far as tho interpretation of the . stature was concerned, the word remained the same to-day as it did in 1881. when the original Act legalising the use-of the totalisator was passed. Witnesses for the detenoe in the court below had spoken as to what the public consider the word to mean to-day, hut there is no guide to what legislation meant in 1881. The boxes complained of had none of the characteristics of the original totalisator, and' in the -light of the statute they cannot he considered a

portion of the totalisator. The. essential feature was tho mechanical device for indicating the .(mount laid on each horse and incidentally the total amount laid on a. race. Mr Justice Reed remarked that he wag at a loss to know why the police had brought the prosecution, for there was no allegation of abuse against the metropolitan club. F. roister, ami durmg the proceedings • keen discussions took place -concerning the' administration and preparation for the coming season. The adoption' of the. report and balance sheet was moved by the chairman, who complimented three Inembers of the executive. Messrs H. Fulton, J. N. Fraser and A. Thorpe, iiiion attending thirty-one meetings out ol thirty-two, pointing out that the fact of their attorn.on to the ciuli’s business showed their interest iu its welfare dud- the sport generally. He referred to the successes abroad of Miss Norma "Wilson, stating the club was proud oi her achievements on the Hark at: the Blvm-p-ic Gaines and in England, and likewise her' victories oi' New /-.calami.
