AN EX GRATIA PAYMENT?
CHRISTCHURCH, April 8. Is the final payment —or so-called bonus —paid by the dairy factory to the supplier at the end of the season, part of the price which the dairy factory is expected to Pay for butterfat, or is it an ex gratia payment—•a true bonus? This is the question m a test case being brought by Walter Frec&grick Kerr, of Oxford, against (Proprietary) Dairy Company, in liquidation The claim is for cniv £l4, but it is claimed, that on the issue of the case depend many -others, involving thousands of pounds. The plaintiff was paid during the 1924-25 season Is 33d per lb. for butter fat supplied to the factory. He received no bonus at the end of the season, as in* previous years. Other factories, he alleged, paid at the rate of Is 7-id per lb during that season. He claimed, therefore, that lie should have received 3Jd per pound bonus at the end of the season, either as bonus or as the balance of the purchase price due. , The case was heard by Mr -justice \lper«, who reserved his judgment.
