JUDGMENT SUMMONS CASE

MAGISTRATE MAKES ORDER. At the Magistrate’s Court yesterday, before Mr J. S. Barton, S.M., J ohn Harold Kano (Mr Dunlop) applied for judgment on an order against S. Aston (Mr Burnard) . Counsel for the plaintiff said that since- the judgment debtor’s last appearance lie had done nothing in the direction of making any arrangement for the payment of the amount as suggested by the Magistrate. An order of £lO a month was applied for and, to which the defendant had previously agreed. Mr Burnard intimated that tho defendant was going to sell his Grey Street property, but just prior to tho sale the agents tried to arrange tho deal at an unsatisfactory figure and ho cancelled it. He had made an assignment of the property on the lines of the Magistrate's suggestion on his former oppearahee. There was no actual drop of value in the properties but it was difficult to realise on them. The judgment debtor gave evidence on similar lines to that at the previous sitting. Ho had, he stated, agreed to sell the Grey Street property to meet the claims of the creditors. Negotiations had been concluded with a land agency firm on Wednesday and had proved unsuccessful. He waS offered £3,250 for the property with £SO in respect to commission and £2,000 mortgage. His partner wanted a clear £I,OOO. He owed money to other creditors besides Kane but he did not consider that he would do better by selling out now. Replying to Mr Dunlop defendant said li e was not trying to evade his debts-. He was not paying any of his creditors but was doing his hast to meet his obligations. If he paid £lO a month he would not be able to meet his other creditors. The Magistrate said he was not satisfied that the defendant liad endeavored to pay hi’s debts or that he had made any such effort during the past month. Defendant was ordered to pay the amount of £64 2s and £1 11s 6d solicitors’ fees, the warrant to be suspended so long as £lO was- paid on the 18th of each month beginning on November 18.
