FINED FOR NEGLIGENT

DRIVING

A fifteen year old boy was charged at the Juvenile Court yesterday before Air W. A. Barton with having driven a motor oar in a negligent manner in Gladstone Road on August 14. Constable Lecide stated that about 7 o’clock on the evening in question he was on a tramcar and when near Gladstone Road he saw the defendant swerve from the left to the right of the road to go up the road referred to. The ear struck one of the rear wheels of the car. which was travelling at about- 14 miles per hour. Th e promptitude of the- driver of the tram in applying the brakes undoubtedly saved the hoy’s life. When questioned about the matter the boy stated that he did not see the tram. Mr Burnard: Is it not a fact that tho tram cars here are very dull looking objects? Witness: Oh, no; it was as brightly lit as ears generally are. The constable added that he had not seen the boy driving previously. Thomas Fahey, who was standing on the platform of the car, corroborated the evidence of the constable and added that tbe boy did not look round to see whether there was anything coming: behind. Replying to Mr Barnard, witness said there was a good headlight on tlie car which could he seen from the post office to Roebuck Road- in ffict, if he could not see it he would not drive a car. . .. The defendant, in the box, said that he had b*en driving liis father s car for about 18 months to two years. Qn the occasion in question he was turning round in Gladstone Road and did not see the tramcar. V here were two hoys in the motor car at tlie tlT Jack Robb, who was in tlie motor car at the time, stated that he was of the opinion that the collisi n was the result of a pure accident. A fine of £2 and costs was imposed. -
