FURTHER. DEVELOPMENTS. On June 28, 1913, His Honor Mr Justice Cooper, at the Supreme Court sittings at Gisborne gave a decision setting aside an order of adjudication in bankruptcy made by Mr W. A. Barton, the Registrar, against Frederick Conrad Patrick Fiddy, of Gisborne, baker. Immediately afterwards on the sanle day. on the appli°t^ r J• H- Kirk, the plain- ™ j-’v Wm. Douglas Lysnar) obtainJudgment for payment of £‘S9 uud costs against the said F. C. P. biddy before the Stipendiary Ala sistrate, Air R. S. Florance. The Magistrate, on Air Kirk’s application, made an order at the same time for immediate execution. Air W. Arnold (Hut* chison and Arnold) opposed these applications on behalf of the defendant and gave notice to appeal. At the Supreme Court, Wellington, Yesterday (Thursday) the Chief justice heard the appeal on the application of All* G. Hutchison (of the firm of Alessrs Hutchison and Arnold) when the Court- ordered the judgment of Mr R- S. Florance to be set aside as a nullity with costs (£5 os) and disbursements against the plaintiff. The Chief Justice expressed’ the opinion that if no fresh adjudication has been ■made against Fiddy that the plaintiff can on notice to defendant resume proceedings to obtain judgment against Fiddy in the Alagistrate’s Court. This, however, cannot be done at present until the order setting aside the adjudication in bankruptcy on the decision given by His Honor. Mr Justice Cooper, has been sealed 'and filed on the records in the Supreme Court at- Gisborne.
