TOTE BETTING.
magistrate overruled by JUSTICES. CASE DISMISSED. (By Telegraph—Press Association.) Dunedin, last night. The first of the charges of betting on totalisator odds against Peter Grant, of Barnett- and Grant, bookmakers, being the sequel of a recent raid by the police, came on at the Police Court to-day. In addition to Mr Graham, S.M., four J.P.s put in an appearance and took seats on the Bench. Two witnesses called declined to give evidence which might incriminate them. Mr Graham, S.M., thought that he had power to issue a certificate of indemnity, and the Crown Prosecutor produced a telegram from the Justice Department that if the witnesses gave full evidence they would not be proceeded against. The majority of the Bench overruled the Magistrate’s opinion, and the case was dismissed on the grounds that the amount paid out was not the same as the tote dividend. There are 58 other charges, which were adjourned to December 5.
