A DIVORCE SUIT.
THE WIFE THAT NEVER RETURNED. By Telegraph—Press Association. Dunedin, last night. At the Supreme Court, in the case in which William Irwin Wallace, of Hillend, sought a divorce from Florence Lillian Wallace, now of Sydney, on the ground of desertion, there was no appearance of respondent. In January, 1896, the wife left on a visit to her mother at Sydney, with the consent of her husband, it being [ understood that she was to return within ' ■ '-nonfchs. She failed to keep her two *— w a ii ace visited his promise, and when .... . . wife ill Sydney in 1898 she absolute,.,--' fused to return with him. It transpired that the desertion did not take place till 1896, and consequently the five years required by the Act had not elapsed when the petition was filed. This proved fatal to the proceedings. The foregoing case was heard under the new Divorce Act, which, among other things, allows a divorce in case of desertion for five years. In this case the action commenced before the requisite period of time had elapsed.
