SHIP DESERTER TO BE DETAINED PENDING DEPORTATION
(P.A.) AUCKLAND, Sept. 3. ‘‘l refuse to grant an adjournment. The court is not going to condone ship desertion by a prohibited immigrant.” This statement was made by Mr. J. H. Luxford, S.M., in the Police Court yesterday when defending counsel asked for an adjournment of two weeks as application had been made to the Minister of Customs for a permit to remain in the Dominion.
The defendant, Karl Johan Mikalsen, aged 29, a Norwegian seaman, had pleaded guilty to unlawfully landing in New Zealand. The collector of customs’ had agreed to an adjournment of the case. Mikalsen was a member of the crew of the Norwegian ship Fred Christensen, which left New Zealand in May without him. The collector of customs asked for a deportation order and imprisonment.
“This is just a plain case of a foreigner deserting his ship and remaining here,” said the magistrate. “If the GovernorGeneral is advised and sees fit he can cancel the order I am making.” Mr. Luxford made a deportation order, Mikalsen meanwhile to remain in prison until a ship is available on which he can be placed.
