APPEAL ALLOWED IN £IO,OOO PRIZE CASE
(P.A.) WELLINGTON, April 6. The Court of Appeal today gave judgment allowing the appeal in the case of Taylor versus the Commissioner of Stamp Duties heard on September 16 of last year relating to gift duty payable in connection with a prize-winning £IO,OOO Tattersall's ticket. The court held that the ticket had been bought by Taylor on behalf of himself and nine members of his family. In such a case, when a ticket was bought on behalf of a syndicate, it was owed equally by all members of the syndicate. When the prize-winning money was distributed by Taylor it was simply a distribution to other co-owners of the ticket and was not a gift to them of money. Accordingly, no gift duty was payable The appeal was allowed and costs in the Supreme Court and the Court of Appeal were given against the Commissioner of Stamp Duties.
