A truck and a car collided In Lithgow on August 4. James Nicholas McKinney, the truck driver, sued Arthur Arnold Eather, the car driver, for damages, claiming that he had lost 16 days work as a wood and pit prop contractor.' He said he had noticed that Eather s windscreen was frosted, there being heavy frost that morning. Eather told the Court that after passing a milk cart he sneezed, and then had no recollection of the accident until he heard some one say. The ’s asleep.” Judge Shortland found for McKinney for £42 loss of work and £23 for damage to the truck.
