SEED GERMINATION DISPROVED BY TESTS A farmer’s claim for £7 refund of purchase monev on grass seed and £lO general damages for loss of pasture because of the alleged failure of ger mination was heard recently by Mr. L. Walton. S.M.. in the Magistrate's Court, and judgment was in favour of the defendant. The Darties were Alfred Saunders (Mr. L. T. Burnard i, a farmer of Matawhero. plaintiff, and C. G. Ancell. Limited (Mr. K. A. Woodward), storekeeper. Makaraka. defendant. The plaintiff admitted the receipt of £2 18s 9d for the unused portion of the seed. He alleged the seed was not fit for the purpose for which it was sold.

Charles Gifford Ancell said he had bought the Dermanent nasture seed from a Makauri farmer. 11 had a germination test of 90 per cent. Vernon Patrick Boot, fields instructor to the DcDartment of Agriculture in evidence, said he had tested the seed at the defendant's reauest and found it to have a germination test of 93 per cent. Judgment was for the defendant with costs. _________
