HARRIS ST. BUS SHELTER COUNCIL’S ACTION In consequence of the decision taken at the previous meeting to seek the advice of the borough solicitors as to whether the recent finding in a Takapuna court case applied to the shelters erected for the benefit of Gisborne bus patrons, a letter was received from the solicitors at the meeting of the Gisborne Borough Council last evening.

The letter pointed out that the judgment of Mr. Justice Callan in the Takapuna case made it clear that the council was not authorised by statute to make provision for bus shelters of such a kind and in such’ a position that a frontager’s private right of access was interfered with, as was the position in regard to the Harris street bus shelter, the removal of which was under dispute. The solicitors also intimated that as the shelter definitely interfered with Mrs. Alison Gambriil’s. section on the corner of Harris street, upon. which she intended to build and occupy a house, failing an agreement with her the shelter would have to be removed. After a short discussion, Mr. M. J. White moved that the council, being advised by its solicitors, could not but comply with the request to move the shelter, but . with the concurrence of Mrs. Gambrill the shelter might be left in its present position until the house was ready for occupation to allow the council to select another site and erect a shelter nearby so as not to inconvenience bus patrons.

This motion was seconded and received the unanimous approval of the council.
