MARRIAGE ANNULLED
RECONCILIATION FAILS AGREEMENT TO SEPARATE In the Supreme Court in Gisborne yesterday Mr. Justice Smith granted a decree nisi to Stephen Thomas Eagle annulling his marriage to Dorothy Valentine Eagle, on grounds of longcontinued separation by agreement. The petitioner, a Te Karaka resident, stated that he married the respondent in 1930, and that later the same year they had separaed by agreement. In .1930 he effected a reconciliation, and made an arrangement that respondent was to make her home with him at Tikiwhata. She failed to keep the arrangement, however, and told him that they must separate again. He had no course but to accept, after endeavouring to get her to change her mind.
After hearing evidence on the length of the separation. His Honour granted the decree nisi. Mr. K. A. Woodward, for the petitioner, said that the respondent would be allowed custody of the child, on the customary terms as to access, by petitioner. An order was made accordingly.
A motion for a decree absolute was moved by Mr. J, S. Wauchop in the case of Kathleen Doreen Lawson v. Cecil Henry Francis Lawson. A decree absolute, and an order for the custody of one child, was made.
Mary Emma Dunshea (Mr. J. S. Wauchop) was granted a decree absolute in respect of her marriage to William James Dunshea, petitioner being given custody of the one child. Mr. L. T. Burnard appeared for the respondent, and stated that no objection would be made as to the custody order.
