UNUSUAL ACTION

JUDGE DISCHARGES JURY NEW TRIAL ORDERED (Per Press Association.) AUCKLAND, this day. The unusual action of withdrawing a case from the jury and ordering a new trial was taken by Mr. Justice Blair in the Supreme Court to-day when defendant's counsel in a divorce suit complained that the petitioner’s father had been seen speaking to some of the jury. His Honour said though the remarks to jurymen might have been innocent, the fact that something had been said created a suspicion and he had no option but to discharge the jury and order a new trial. He granted £2l costs to the respondent.
