APPEALS UPHELD IN LIQUOR TEST CASES
WELLINGTON, This Day (P.A.).— Arising from the decision by Mr J. R. Herd S.M., at Palmerston North, subsequently quashed on appeal to Mr Justice Gresson, that beer must be proved by analysis to contain more than three per cent, alcohol when the subject of a liquor prosecution, three appeals were allowed in the Supreme Court today by Mr Justice Hutchison. The Crown, represented by Mr W. H. Cunningham, appealed against the dismissal of three cases of selling liquor after hours. The charges had been heard before Mr Herd at Masterton. Counsel for the defendants said that no argument would be offered, since Mr Justice Gresson’s judgment had been given in the interim. The appeals were allowed, with costs against the defendants, Raymond Knowles and Edgar Lenihan, both barmen, and Kenneth Jack Sutton, a hotel licensee. His Honoi' referred the cases back to Mr Herd for judgment in the light of the decision on appeal.
