TREASON CHARGE
THE COUSENS CASE SYDNEY, August 8. The New South Wales Full Court reserved judgment on the question whether a rule nisi prohibiting tn„ Magistrate at the Central Police Court from proceeding further on die treason charge against Major Charles Cousens should be made absolute Major Cousens yesterday asked the Court to make absolute the rule nisi. Yesterday three Judges of the r ull Court expressed doubt whether they had the power at this stage to prohibit a magistrate from proceeding with the charge of treason against Major Cousens. The point raised wa that the magistrate would merely be making a preliminary investigation, and that following his findings it Would be for the Attorney-General to decide whether the indictment should be filed committing Major. Cousens for trial. . Mr Justice Street said that if an indictment had been filed there would be no doubt about the Full Court’s power.
