FARMER’S COMPLAINT AGAINST BOMBERS RIGHT TO LEGAL REDRESS WASHINGTON, May 28. The United States Supreme Court has recognised the present age of flight by creating a new precedent extending property rights to low altitude. air space. The court’s ruling has two main points:— (1.) A landowner has the title lo as much air space above his property as its use and enjoyment requires.
(2) The repeated invasion of such air space by low-flying aircraft is a trespass and is subject to legal redress.
The case was brought, by a North Carolina farmer whose chickens were so badly scared by Army bombers that they flew into fences, breaking their necks.
