LAND AT CHATHAMS
PLAINTIFFS’ CLAIM FAILS [PEB PBESB ASSOCIATION.] WELLINGTON, July IS. Claiming £5O, which they alleged they had paid to Emma Hensen, an aboriginal native, by way of deposit for a piece of land at the Chathams, E. and J. Hough, infants, recently sued by their next friend for the recovery of that amount from the Public Trustee. Mr. Luxford, S.M., in a judgment delivered to-day, said that plaintiffs must be non-suited, and their next friend ordered to pqy costs according to scale. He said that the onus was on plaintiffs to prove that the land they agreed to buy had no tangible value, and this they had failed to do. They also failed, on the ground that they had not proved they had paid any money at all to Mrs. Hensen.
