STRUCK BY HEARSE
CYCLIST AWARDED DAMAGES
SYDNEY, February 8
A man who was injured l.y a motor hearse was awarded -Cl3O damages by Judge- Clancy in the District Court yesterday. He had claimed £2OO. Evidence was given that the plaintiff, Edward Kimberley Hammond, of Station Street, Tempe, tram driver, was riding a push cycle along New Canterbury Road, Petersham, on September I. 1938, ami that, when he was mar the intersection of Gordon Street, he was struck by the hearse, which belonged to Mrs. P. Kirby and Son. Ltd., of Elizabeth Street.
Hammond alleged that, the accident was duo to the negligence of the company's. servant. This allegation was denied by (he company, which also pleaded contributory negligence by 1 lammoml.
Norman Ireland gave evidence that lie had seen the accident. Mr. L. C. Furnell. who. instructed by Mr. A. .1.
