Herron I for Huddart Parker, Limited), applying for a nonsuit, said that a person who went to a ship to see friends was not an “invitee” of the owners. He was merely a “licensee.” and the company was not liable for injuries received by him in an accident unless a “trap" were set. His Honor: It may be that that is so if he merely walks on board to see friends, but if he carries any of the passenger’s luggage may he not be in the same position as a luggage porter—even though he be not paid for it—or of a person having business with the ship? Mr. G. Arnsberg (counsel for plaintiff) urged his Honor to inspect the ship. „ . . Mis Honor: My law is out of date, but I am not going to hear new evidence on an application' for a nonsuit while the jury is absent on an inspection of the ship (the jury had retired for that purpose). Do you, Mr. Herron, consent to the Court being held aboard the ship? Mr. Herron: No. your Honor.
His Honor: Even if Mr. Herron consented, the company may not have me on board. At this stage the jury returned to Court and the foreman announced' that it had reached a verdict lor the defendant company.
