1938 Derby: The Canterbury Jockey Club has received the nominations of. 145 yearlings for the New Zealand Dei by Stakes of 1938.

Haut Monde: Haut Monde left last week for Randwick, where he is to go into the stable of the ex-New Zealand trainer, G. Price. Haut Monde is one of the first of the Dominion horses to be on the scene in Australia for the big Spring races.

Jumping Strain: Amongst the winners at the South Canterbury point-to-point steeplechase meeting on Saturday was Phaeton, a halt-brother to Lord Ranald, and owned by Mr B. Fechney, of Ashburton. Phaeton is a natural jumper, and is likely to be seen out in hunters’ races next month.

Gay Rose: , On the eve of leaving for the Great Northern meeting at Ellerslie, Gay Rose showed signs of going off a little, but since she is displaying plenty of vim, and she has probably never been in better condition than at the present time. She is to race at Te Awamutu, and if the course is in reasonably good condition she may be depended' upon to run prominently.

Engaged at Waipa: At the Waikato meeting last month Sunny Downs ran two good races, and his second to Hunting Star on the second day indicated that he may soon reach the winning list. The, Acre gelding is at home in any sort of going and stays on better than the majority of hacks racing at the present time. If produced at the Waipa meeting next Saturday, Sunny Downs will not be neglected by the public. •

Showed Speed: The two failures of Pirate King at the Great Northern meeting proved costly to his for a lot of money was invested' on him each start. He showed abundance of speed in both his races, but did not finish as well as expected. As he has not been over-raced and is only a threer year-old a good future should be in store for Pirate King when he becomes properly seasoned. Sound Opinion: “You can say that Pooley Bridge will win the double. I thjnk he’s a good proposition in the hurdles and even better in the steeplechase.” This was. the confident statement of L. Healey, Pooley Bridge’s rider, when he learned that his mount had been rebandicapped 31b to 12.8 in the Victorian Grand National Hurdles, for winning the York Hurdles. Healey has won nine races in 10 rides on the champion, including the Grand National Hurdles and Australian Hurdles last year.

CLAIM FOR DAMAGES | INJURIES TO MALA. SYDNEY. June 22. Henry Edgar Russell, owner and trainer of Mala, began an action in the Supreme Court yesterday against the Commissioner of Road Transport and the tramways to recover £2,000 damages owing to injuries to the racehorse Mala when the colt was struck bv a tram on Derby morning, October 3.’ Mr. J. Cassidy, who is appearing for

’Russell, claimed that Mala injured his fetlock and legs, as a result of which his chances of winning the Australian Jockey Club Derby and subsequent Sydney and Melbourne classic events, also the Great Northern Derby in New Zealand, were seriously prejudiced. The mishap, Mr Cassidy contended, was primarily due to the excessive speed of the tram. To-day’s evidence was directed to show that Mala was very excited after the tram mishap. He required hosing on the course before the Derby and appeared slightly lame. A New Zealander, Keith Raymond Guthrie, who had charge of Mala on the morning of the accident, said Talking beat Mala in the Derby and Gold Rod was third. Guthrie declared he did not hear a veterinary officer tell Russell on the Randwick course that Mala was quite fit to take part in the Derby. • Asked by Mr. Lamb, K.C., who is appearing for the Transport Commissioner, whether it would be cruel to start a horse which was lame, Guthrie replied: “It would appear so, but it is done every day in the week.” A jockey, Maurice McGarten, the rider of Gold Rod, described the running of the Derby. He said Mala finished well, and on his Dei by run would have, been a good thing for the Clibborn Stakes, from which he was scratched. Mala finished well in the Cox Plate at Moonee Valley and in the Melbourne Cup, but he was sore after the Cox Plate. This condition might in some way be connected with the injury received in the tram accident. Russell in his evidence, said he was sure he was going to saddle a Derby winner, with Mala, but the accident upset him. and made all the difference between a win and a loss. The following day, the colt walked short in the front leg, as well as in the hind leg. 'i’he case was adjourned.
