DUNEDIN, July 1. Justice Kennedy was engaged in the Supreme Court to-day in hearing a claim for £5,000 against Francis Cecil Taylor, accountant, of Dunedin, brought by Jessie Marguerite Bailey, widow of Howard Bailey, who was killed when an aeroplane, in which he was a passenger, crashed near St. Andrews, on November 24, 1934. It -was alleged by the plaintiff, that

the defendant, as pilot of the machine, had' negligently failed to use reasonable care and skill in piloting, in that he had not maintained an adequate flying speed or an adequate height above the ground, as the result of which the plane had stalled and crashed. After lengthy evidence was heard, the Court reserved its decision.
