TIMBER MILL FIRE
RAILWAY TO PAY £15,070 [PER PRESS ASSOCIATION.] AUCKLAND. May 1. hearing of the petition for £15,070 damages brought by the Morningside Timber Company, Limited, against the New Zealand Railways Department, was concluded before Mr. Justice Callan and a special Jury in the Supreme Court, to-night. The action was the sequel to an extensive tire on December 1, 1934, which, it was alleged, originated from a spark from a railway engine passing the Company’s premises, which adjourned the railway line. The Jury decided that the fire was caused by an emission of material from Engine A 601, and the Jury also absolved the Department from negligence in the use of the particular type of spark arrester on the engine, and from negligence in the driving ahd firing of the engine; but the Jury also found that there had been negligence in the construction, maintenance or condition of the spark arrester and in the use of brown coal in the engine at the time. The Jury found that the destruction of the Company’s property was not contributed to by negligence of the company in allowing dry grass or rubbish to remain on its property, or in failing to provide a fire-break.
His Honor adjourned the matter in order that the quantum of damages might be discussed.
