LIBEL ACTION FOLLOWS Decision was reserved by Mr. S. L Paterson. S.M., in the case at tin Hamilton Magistrate’s Court in whicl Arthur Henry Piper, motor engineer of Hamilton (Mr. Clayton-Greene)
sought to recover £2OO as damages from James Alfred Thomas, motoi engineer, of Frankton (Mr. King), foi alleged libel and defamation of char act er. Plaintiff, in his statement of.claim alleged that defendant readdressed a letter to “Mr. A. H. Piper, care ol Replacements, Frankton,” as follows: “Motor Wrecker, Victoria. Street, Hamilton.” The words “Try Avondale,’’ were written in one corner. Plaintiff also objected to defendant displaying in his own shop an old car axle with
the words “Piper special” on it. Mr. King said he had written to plaintiff on behalf of defendant apologising and offering £5 towards expenses. His client realised he went too far in the matter of the axle, but suggested that the words, “Try Avondale” did not necessarily mean the mental hospital but could refer to the Avondale post office.
