BULL GORES HORSE
CLAIM FOR DAMAGES. [PER PRESS ASSOCIATION.} AUCKLAND, September 11. An action arising out o£ the loss of a pacing gelding, Silver Bingen, which, it was alleged, had to be destroyed after it had been gored by a dangerous bull belonging to defendant, was heard in the Magistrate’s Court, when the owner of the horse, Mrs I. E. Sweetapple, claimed £152 damages, including £2/2/veterinary surgeon’s fee, from Hugh Hedley, farmer, of Auckland. In the statement of claim, plaintiff raid that Silver Bingen had been delivered to defendant on April 13, and in return for caring for the horse he was to receive 5/- per week. It was alleged that owing to defendant’s negligence, the horse was attacked by a bull in the same paddock, with the result that the horse had to be destroyed on May 22. The defence was that there had been no contract between plaintiff and defendant, and that defendant was not guilty of negligence. The case was adjourned until tomorrow.
