BARRYTOWN LAND

MINING RIGHTS REFUSED. In a reserved decision, delivered m the Warden’s Court at Greymouth, yesterday afternoon, Mr W. Meldrum refused' the application of Raymond, John, and Anthony Poschich for an ordinary prospecting license of 100 acres in Block 9, Waiwhero S.D. The area is located at Barry town, and the application was objected to by Daniel and J. M. Dennehy and the New Zealand Flax Investments, Ltd. Mr M. B. James appeared for the applicants, and Mr T. F. Brosnan for the objectors. The Warden referred to the efforts made to secure the exemption of the land at Barrytown from mining, and said that a report had been forwarded to the Minister, who had consulted with the Director-General of Agriculture. The only inference to be drawn from the Minister’s letter was that the application for exemption would be kept alive by the Minister, until he heard the results of the prospecting on the 600 acres already granted for that purpose. In the event of the prospecting not being gone on wit.n, the matter could be brought before the Minister for review. Meanwhile, the original application would be kept alive. That being so, said the Warden, unless the consent of all concerned in the land were obtained, he did not think it would be the proper course for him to take, to grant ordinary prospecting licenses. Certainly, the land under the Act was regarded as Crown 'land, and was open for mining, but the Minister had stated that the application would be kept alive, pending further review. In refusing the application, the Warden said that he had come to the conclusion that no further mining rights should be granted at Barrytown, pending the results of the prospecting on the area of 600 acres over which prospecting licenses had already been granted. Mi’ Brosnan asked for costs, and was allowed £3 3/- solicitor’s fee, and 15/each for two witnesses.
