P. & T. v. BOROUGH COUNCIL
IMPORTANT TEST CASE. [per press association.] AUCKLAND, September 20. The King against the Pukekohe Borough Council, ivas the title of a claim heard in the Supreme Court, today. The Crown, representing the Post and Telegraph Department, claimed £B/11/- damages, on the ground that while constructing a road', the Council interfered with an electric telegraph cable. The defence contended that there had been no interference and that the damage was caused by the action of the elements. Counsel for the Crown said the amount claimed did not indicate the importance of the matter. It is important because witli the growth of country towns, and the necessity of widening roads, there frequently occurred clashes between the national and local authority. He submitted that the council in carrying out w 7 ork which they were entitled to do, had endangered a public service, and that they were responsible for damages. Evidence is being heard.
