CLUB QUARREL
DAMAGES FOR DEFAMATION. (Per Press Association.) WELLINGTON, July 31. Reserved decision was given to-day by the Magistrate, Mr. McNeil, in the case in which William Tressider, watersider, claimed £lOO damages from John Barrett, one time manager of the Courteney Club, alleging that defendant had accused him of robbing a young man named Fitzmaurice, by using a crooked dice in a game of hazards at the Club. The Magistrate found that a case of defamation had been established. In regard to the defence, that the action could not be upheld as the alleged slander arose out of participation of an illegal act, namely in playing a game of hazards, Mr. McNeil said it was decided that in cases which showed that even if a man had taken part in an illegal transaction he was not to be deprived of all protection in other matters connected with the transaction. The sum of £l5 damages was awarded.
