C. .Murphy became a partner with William Ryan, a book’maker, in the horse Cherry Ripe, and in the subsequent racing of the horse in Australia and New ZealandMurphy asserted that he bought the horse from Ryan in May, 1922, and that after that date Ryan had no interest in the horse, lhe District Committee, by a majority, decided that the charge against Murphy was not proven. The Judges were of the opinion that the charge against Murphy was conclusively "’establ ished ami strengthened by his own statement and conduct. The offence was serious and deliberate, and continued for a- period of years. Ihe appeal was allowed. Murphy was convicted of corrupt practice, and was disqualified I'or five years.
