SUED BY PATIENT
SURGEON TO PAY £lOOO.
A special jury'at Winchester Assizes, after a hearing which occupied three days, awarded £lOOO damages against Dr. Lysander Maybury, of Hampshire Terrace, Southsea, in favour of Mr. Percy E. John Powell, a fancy goods dealer, carrying‘on business at Southsea and Portsmouth, for alleged negligence and of unskilful medical treatment.
The case for the plaintiff was that in November, defendant treated him for neuritis in the right arm, and he alleged that in endeavouring to break down an adhesion in his right arm Dr. Maybury dislocated his arm and broke off the lesser tuberosity of the humerus. It 'was alleged that Dr. Maybury. used greater violence than was necessary, and that the violence was negligent, and unskilful. Dr. Maybury, it was submitted, performed an operation on plaintiff with the object of reducing the dislocation. This he failed to do, and despite subsequent attendances no further steps were taken to reduce the dislocation. His right arm was now two inches shorter than his left, and he suffered permanent inability to lift the arm away from the body. The defence was that Dr. Maybury, who was surgeon to the Portsmouth Borough Police Force, a doctor of medicine and master of surgery, and a member of the Royal College of Surgeons, had in this case diverted in no way from the practice he had conducted during his 40 years’ experience in Portsmouth.
