VALUABLE LAND.
A COMPENSATION CASE. [BT TELEGRAPH —PER PRESS ASSOCIATION.] WELLINGTON, June 29. An interesting compensation ease, A. T. Bale and J. A. Pike v. the City Council, has been decided hero by Air Justice Sim and Messrs G. H. Scales and A. H. Miles ,assessors for plainttiffs and defendants respectively. The sum of £370-3 18s was claimed as compo..sation for all loss arising out of the taking of lands adjacent to the Duke of Edinburgh Hotel. The sum of £2212 10s was claimed for 29ft Gin of land, with a depth of 10ft at £76 per foot, fronting Willis street, having regard to its special value, use, and adaptability. Interest at G per cent on £17,745, heing_ the value of tho whole section, from oth May, 1908, bo Cth August, 1910, amounting to £1331 os, “wits asked. For east of specifications and plans prepared for tno purpose cf erecting a building rendered useless by the taking of the land £45, and costs' of previous claims rendered useless by proclamation being revoked, £52 10s, were also claimed. “The award of the court,” said his Honour, “is £18855 10s in full _ settlement of all claims, made up in this way:—Interest for 15 months at 6 per cent., £498; compensation in respect of land taken, including interest not already allowed, £1260; architests fees agreed on, £52 10s. Me award the claimants £SO for costs, and the assessors’ foes are both fixed at £ls 15s for the two days, to. ho paid by respective parties.” Tho allowance for doprocitaion of the property byreason of the taking of the 10ft strip worked out at £42 per foot.
