WELLINGTON, March, 14. "Does marriage end incapacity?" This poser will have to be considered and ruled upon by the Arititration Court in connection *with an award granting compensation to Adelene Bernasen formerly an employee of Ross and Sons, Foxton. Mr. P. J. O'Regan representing Mrs Bernasen, applied to the Aribtration Court to commit the weekly payment into a lump sum. When plaintiff was a- single woman she met with an accident while in defendants' employ, losing her left arm She was granted os per week on account of incapacity, and this payment continued until her marriage when defendants discontinued it. They were willing to commute and the Court was asked to fix the amount. He maintained that marriage had not lessened defendants' liability. The President (Mr. Justice Sim).— I suppose she has a husband who keeps her? Ml*. Levi (representing defendants) said he was not in a- position to go on with the case and knew nothing of the facts. ' Mr. Justice Sim—Supposing instead of getting married, she had succeeded to a legacy, making her independent, you don't suppose she would not have been entitled to the allowance? Getting married does not remove her incapacity or give her a new arm. Mr. Levi would not argue the position, and the case will have to come up again before the Court.
