The finding was in favor of the jockey, the judges ruling being that they "Do not find any evidence that appellant did jostle Pevrmporl (first jostle alleged in race) and in respect of the alleged jostle with lena there is not sufficient evidence to satisfy the judges thai a jostle (for which no action was taken by the stewards to question the result of the race) was, if it occurred, caused by any wilful or oven negligent act of the appellant." The appeal was quashed, and the deposits lodged by the appellant with the conference, and with fin 1 metropolitan committee refunded.
