Tn his reserved judgment the Chief Justice, in tire case in which Nasli, owner and driver of a service car plying between Napier and Hastings, appealed against in’s conviction I>y a Magistrate for- .a, breach.of the bylaw reverses the decisio and allows costs. THE DEFINITION His Hnwuw stated that the- -appellant’s vehicle did not come within the definition of borough omnihiys as the l crmi'lii were .not birth within, the tioi tugh. Tile vehicles Were therefore motor cabs, under which licenses they have been operating. They were, however, liable to taxation in Troth' boroughs.
