That a motor hiring firm must supply a car in a condition satisfactory for tlie-jouriiey to he undertaken was (lie decision of Mr. E. Bnrnard sued IVollington Rental Cars Ltd. for £4K 10s. being the amount of hire paid in advance, in addition to running costs and per.tonal expenses incurred, owing to the alleged failure of the ear to complete the journey for which it had been hired. It was admitted that Iho car had boon hired for 28 days for a trip to North Auckland, the hire being £22 paid in advance. Plaintiff staled that there was a slight noise in Ihe hack axle when lire took the car over, but it became steadily wors,. and the crown wheel and driving pinion hail to be renew'd at Taupo, occasioning a three days' delay. Further trouble was experienced between Taupo and Rotorua and plaintiff decided it would lie impossible to carry on during Hie time tli t . ear was on the road.
