Judgment was given by Mr Justice Cooper to-day in the appeal by Mrs Weiss against he conviction for having sold New Zealand wine containing a greater quantity of proof spirit than she was authorised by her license to sell. His Honor held that it was not necessary for the prosecution to prove knowledge on the part of defendant, nor did ncr absence of knowledge exculpate her. The defendant's license authorised her to sell New Zealand wine containing not more than 20 per cent, of proof spirit. She had sold wine containing appreciably more than 20 per cent. She, therefore, sold liquor she was not authorised by her license to sell, and could not escape from the consequences of that illegal sale. It was contended that she suffered hardship as the producer represented that the wine did not contain more than the authorised amount of proof spiririt. His Honor answered that she had her remedy against the manufacturer. The appeal was dismissed with seven guineas costs.
