FEILDING COURT.

♦ Police v. W. Archer. At the Police Court this morning, before Messrs J. Eirton and B. Burne, J's.P., Walter Archer was charged with the theft of £o 10s from the person of Gustave Erugher on January 28rd. Mr Carty appeared for the accused. Gustave Erugher deposed Chat on the 23rd mst he came to Feilding with a cheque for £5 and two £1 notes. He cashed the cheque. When he went into the Manchester Hotel about three o'clock he had a pound note, a sovereign, and a half sovereign. He met accused there who shouted for him. He did not return the about. Accused put some small boxes (produced) into his pocket, and then left. His money was in a small pocket in his coat on the right hand side. After accused left he missed his money aud reported the matter to the police. By Mr Carty : When he came into Feilding he had two drinks at the Manchester Hotel. Also one at the Empire Hotel. He drank brandy and soda each time. He bought some boots which cost £1 7s 9d. Was not certain whether the bar maid refused to serve him with drink, Pressed for an answer he did not know, what state he was in. He should have said £2 10s was taken and not £5 10s. He remembered accused saying that he would only drink with him if he drank soda. The Bench here remarked that they were under the opinion that witness was in a perfect state of muddle in the afternoon in question. Beatrice Mullooly, barmaid at the Manchester Hotel, said she did not supply Erugher with drink, because he was intoxicated when he came into the hotel. He went into the other bar, where accused and a friend were sitting in the. new bar, and remarked that he was drunk. When witness returned from dinner she saw him at the slide in the passage. She did not see accused again until nearly 6 o'clock, when he shouted for three friends. Later on he called for more drinks, and gave a half sovereign to pay for them. W. Jodbs, porter at the Manchester Hotel, deposed seeing the accused, Krugher, and another man at the hotel. He refused to give Kruger a drink, as he was' intoxicated. a He gave him soda. He paid for* the three drinks. They had about three prinks each. Did not see the accused putting anything in Erugher's pockets. Constable Henderson deposed that Kreegher reported the matter to him that he had been robbed of Ld 10s. Subsequently he arrested accused at about 7 p.m. the same evening. He had one soverign and 8s 9d in silver. ErVighec was under the effects of drink when he made the complaint. After hearing the evidence, the case was dismissed.
