ALLEGED UNSKILLFUL SURGERY

In the Supreme Court bloodless surgery case, Miss Jessie Graham against Dr. Herz, m which the plaintiff claimed £500 general and £274 special damages, caused by alleged unskilful treatment and negligence, was continued to-day. The head nurse at the hospital where the plaintiff was treated stated that Dr Hera had taken every precaution, and was even more particular in the plaintiff's case than in others of the same sort. When Dr. Herz went away in February he left another doctor in charge of the ca.se. Plaintiff's foot was then healing properly, and there was really no necessity to call in a doctor during the time the defendant was away. Several medical witnesses gave evidence that the gangrenous con* dicion of the foot was due to thrombosis m the artery, and not to tightness of the plaster c^at, and nothing could have been done to pre- ! vent thrombosis, for that was one oi the risks. thajfe had to, be tahen. Everything that could be done had beeu dope under the circum stanoes, and Dr Herz's treatment showed no negligence or want o( skill. The Jury, after four hours' retire* ment, disagreed, and the case was adjourned till next civil sittings.
