' All five Judges were present. Dr Findlay, in opening the case, stated | that he was unable to support the first j portion of the notice of motion. The Court decided to hear the Crown in reply on Monday morning. This Day. The Appeal Court unanimously dismissed the application in the Dean case for leave to appeal. When the Appeal Court resumed, the Bench said it was unnecessary to call on Ml- McDonald to reply as the Judges were unanimous there was no case to answer.
