A Conviction Quashed.

Q (Per Press Association). Dunedin, March 19. Justice Williams to-day gave his decision in the Appeal case in which George Aloes had been convicted by Mr Rawson, S.M., of Invercargill, on an information charging him with obtaining £8 by false pretences. His Honor said the only evidence of false represen cation in writing was that the appellant gave a cheque drawn ! by himself on the bank, at which he had no account and which he knew would not be paid when presented. That was no false representation in writing, but the order for payment of money. What might have happened had the appellant, been charged with false veibal misrepresentation it was unnecessary to determine. The appeal must be allowed and the conviction quashed. Appellant ought to have been committed tor trial on the original information.
