MILITARY DEFAULTERS

WHEN WILL THEY BE RELEASED 1 I INTERESTING POINT RAISED (Special.) WELLINGTON, August 20. One of the questions ,up for decision now that the fighting is over is the position of the military defaulters, 600 of whom are detained in various camps in New Zealand. They were sentenced to detention for the duration of the war. . ..

No official information is yet available .regarding the steps which will betaken with the defaulters, but the legal position has been clearly defined in°legislation passed only a few weeks ago. “ The duration and termination of the war ” is to be determined by clause 16 of the Finance Act. . This states that the war is the war with Germany, and includes the war with Japan, and that in any Act or regulation passed since the war commenced the war shall ho deemed to be existent until a date to be named in a proclamation naming the date of termination is gazetted. The legal effect of this provision is that defaulters can be detained until a date to be announced in the ‘ Gazette,’ and it is an interesting point for future decision by the Government whether this will be the date of the signing of a peace treaty with Japan or the general settlement, which may be months hence.
