VALIDITY CHALLENGED (P.A.) WANGANUI, May 9. A submission that the Horse Transport Control, Notice recently issued was ultra vires was made in the Magistrate's Court to-day, when four owners and trainers of racehorses were charged with using petrol for transporting horses more than 30 miles for other than agricultural purposes. After hearing evidence, Mr J. H. Salmon, S.M., agreed that the cases be adjourned until the decisions in similar cases heard elsewhere were known. • Defendants were David Marks; of "Fordell; 'Maurite Brooks, .of Stratford; Francis Henry Walker, of Hawera; 'arid George Bowden, of New Plymouth. A similar charge against .William Eva, of New Plymouth, was adjourned to May 22 to 'enable him to.be represented at the hearing.
