APPEAL UPHELD SHAM BOY-CIRCULAR MOTE CASE [Pan United Press association.] CHRISTCHURCH. March 12. The appeal of O. F. Watson against the decision of the Dunedin District Committee in the Sham Boy-Circular Note case has been upheld by the New Zealand Racing Conference. Sham Boy won the event at Waikouaiti, with Circular Note second. The Judicial Committee of the Waikouaiti Racing Club reversed the positions, and when Mr Watson, the owner of Sham Boy, appealed to the Dunedin District Committee, the appeal was thrown out. An appeal against this decision was made to the Racing Conference.

The judges state that the appeal was allowed unanimously. The decision of the District Committee was partly based on a finding that a proved breach of rule 326 regarding the lodging of protests had been waived by the appellant's trainer, S. Barr, at the Judicial Committee hearing. In order to justify the finding, the judgment continues, knowledge of the breach must bo proved against Barr. Barr could not be presumed to know and did not know that the protest had not been lodged in accordance with the rules. AUSTRALIAN NOTES ROSEBERY MEETING SYDNEY, March 12. The Limarch filly Lady Limarch, who has been a consistent place-getter lately, won the Fourteen-Two Handicap. The New Zealander Proud Fox shaped satisfactorily in his first race since coming* to Australia, participating in the Flying Handicap, 6j furlongs, in which he finished fifth. The race’was won by the Epsom candidate, Red Thespian. Besulivre is unlikely to run in the autumn handicaps, and will probably ho blistered. He may have his first race in the Rawson Stakes at Rosehiil.
