NEW TRIAL ORDERED FINDING AGAINST EVIDENCE AND DAMAGES EXCESSIVE [Pee United Peess Association.] • WELLINGTON. June 21. An order for a new trial in the case in which a patient had proceeded successfully against her doctor before ; a jury was granted by Mr Justice Quilliam in the Supreme Court. The hearing took place at Palmerston North three weeks ago. The plaintiff, Olive Rita Paterson, a married woman, of Palmerston North, sued Kenrick Dean, medical practitioner, of Palmerston North, for £750 general damages and £172 6s special damages, alleging negligent and unskilful treatment of an injured knee. Mr Justice Quilliam was on the Bench, and the jury returned a verdict for plaintiff, and awarded her £4OO general damages and £172 special damages. The new trial was asked for on the grounds that the verdict was against the weight of the evidence and that the damages were excessive. After hearing argument from counsel on the evidence that had been tendered at the hearing, His Honour made an order for a new trial on both the grounds that the verdict was against the weight of the evidence and that the damages were excessive.
