COMPENSATION CLAIM
ARBITRATION COURT HEARING AGREEMENT REACHED At a sitting of. the. Arbitration Court, yesterday judgment by consent‘for the gum qf £450; without-, costs, tya#* given in favour, of the’plaintiff in a compensation case; The'case was that'in which Edward Albert Lewis, a seagrass worker, claimed compensation for permanent partial, incapacity arising out of. injuries received, while employed as a grocer’s assistant by Andrew Fibbes, Warrington. Plaintiff was at .the time under 21. Associated with Mr Justice O’Regan on the bench were Messrs W. Cecil Prime (employers’ representative) and A. L. Monteith (employees’ representative). Mr F. B. Adams appeared for the plaintiff and Mr A. J. H. Jeavons for the defendant. ; According to the statement of claim plaintiff received injuries to his head and hand when the van which he was driving for defendant was struck hy a train at Warrington on November 7, 1936, As a result he was permanently partially' incapacitated.- It was alleged that the disability might become and. might remain total. ■
Mr Adams asked for formal judgment. as an agreement, had been reached between the . two parties. Plaintiff had suffered an injury to his skull, and ipart had been,removed. He complained of a-weakness of grip in his right hand. There was some difference in medical opinion as to whether "the head injury caused that weakness, and the doctors also differed , in their opinion as to the mental damage suffered. There was, too, controversy concerning plaintiff’s wage-earning capabilities, but in the circumstances he felt justified in accepting the sum of £450, over and above an amount of £33 already paid to the plaintiff. Judgment was given accordingly.
