NEGLIGENCE ALLEGED
- OMNIBUS AND TRUCK COLLIDE MAGISTRATE'S COURT CLAIM As the result of a collision between a department omnibus and a truck driven by the defendant, the Railways Department (Mr E. S. Tuckwell) proceeded against James Fraser (Mr E. J. Anderson) .in. the Magistrate’s Court yesterday afternoon, claiming damages. The statement- of claim stated that the Railways Department bus, driven by John Mark Ward Kennedy, was travelling on- the Chalmers highway towards Dunedin on June 15, 1937. While passing through ' St Leonards it collided with a truck owned by the defendant and driven by D. Smith. It was alleged that the collision was due to negligence by the driver of the truck. The claim totalled £79 19s—£69 19s for repairs and £I(T for the loss of the use of the omnibus for 10 days. Evidence for the plaintiff was given by A. H. Patrick, Constable M'Whitty, Kennedy. H.* N. Storer, T. R. Evans, and R. Gow. Mr -Anderson submitted that, although the truck had skidded on the greasy road, that skid was not evidence of negligence." • ,- Evidence, for the defence was given by Duncan Smith, the driver of the truck, and Alfred Errol Ansell, The magistrate (Mr J. R. Bartholomew, S.M.) reserved his decision.
