MAGISTRATE'S COURT The weekly setting of the Oamaru Magistrate’s Court was continued yesterday morning before Mr H. W Bundle, S.M. Sergeant M'Gregor conducted the police prosecutions —Licensing Case.— Charles Graham Forbes, as the holder of a publican’s license in respect to the Terminus Hotel at Hakataramea, was charged with selling liquor after hours. Defendant was further charged with opening such premises when they were required to be closed. Helena Elizabeth Forbes, wife of the licensee, was also charged with supplying liquor on the premises after hours. Mr J. E. Farrell represented the licensee, who pleaded guilty topselling after hours, and on the application of the police the other charges were withdrawn. Sergeant M'Gregor stated that .a dance was held in the Kurow Hall on March 17. During the evening Constable Voyce, who was on duty, noticed a truck come from the direction of Hakataramea and pull up outside the hall. On investigation he found a quantity of beer and whisky in the vehicle. There were three young men seated in the front, of the truck, all of whom denied having purchased the liquor from the Hakataramea Hotel. Later, however, one of the men admitted having been at the hotel. The constable made inquiries and ascertained that the men had purchased the liquor efirly in the evening. This. was admitted by Mrs Forbes, wife of the licensee. Counsel said his client had no previous convictions, and although .unaware of the purchase be agreed to take the responsibility. The Magistrate said he would take into consideration defendant’s good record, and imposed a fine of £3, with costs (10s). The license was returned. —Claim for Pent.— The hearing was continued of the claim of James Kennedy, of Willowbridge, against E. T. M'Carthy, of St. Andrews, for £lO 8s rent, £6 damages in . respect to gorse, and £3 for damages to a water tank, a total of £l9 Bs. A counterclaim was lodged _ for £2l in respect to a crop of Algerian-oats. . Mr J. T. Armstrong appeared Tor the plaintiff, and Mr C. Zimmermann for the defendant. , • James Edmond Farrell, solicitor, said he was collecting the rent - from defendant for several weeks. When defendant vacated the premises rent was owing for the months of June and July of the year 1933. That rent had not as yet been paid. Witness was acting at the time primarily for the mortgagee. M'Carthy was an exceptionally good payer, and it was the firm’s wish that Jie should obtain an extended lease. Plaintiff wished to return to the property himself, and witness pointed out that he might again get into arrears, whereas if he left defendant there he could expect a surplus. Witness suggested to defendant that he should withhold some rent in the event of his having to leave the property. The ' Adjustment Commission might then see' fit to remit that rent. Defendant later vacated the property, no renewal -having been granted.. Witness had received no notice, nor had he seen defendant since. Since M'Carthy had left subsequent tenants had proved unsatisfactory. The Magistrate, summing up, found that the facts clearly that the rent had been paid with the_ exception of two months in 1933. Prior to the end of the term defendant desired to renew the lease, and went to Mr Farrell. Defendant ■ gave his , evidence very fairly. The crop in question had been sown carefully and faithfully. As regards the gorse, this was in no worse, position 'when defendant left the property than when he took over the property. There was no claim made at the time in respect to the jgorse and the tank. It .was claimed by the defendant that he received no benefit from the crop; but the fact that the place was uninhabited when he took oyer overruled this points He did not think the matter should be considered from a legal aspect; more so from the benefits derived by both parties. Defendant had acted fairly and honourably; therefore judgment would bo for defendant on the claim, and plaintiff on-the-counter-claim, under the equity and good conscience clause of the Magistrate’s Court. OBITUARY An old identity in the person of Mr Andrew Gray, of Orwell street, has died. ißorn in Glasgow in 1850, the deceased gentleman was educated at Millerstown, and was brought up to a country life. He . emigrated to New Zealand in 1879, arriving at Port Chalmers, and coming almost immediately to Richmond, where he worked for several years. In 1886 he married a daughter of the late Mr W. L. Gray, there being one son and three _ daughters of the union. After retiring he came to Oamaru to live, and for a number of years served on the committee of the Pukeuri School. He was also an, active member of the Papakaio Church, In later years he joined the St. Paul’s Presbyterian Church, and tok an active interest in its management. For many years he was a director of the North Otago Farmers’ Co-operative Association. Of a retiring disposition. Mr Gray nevertheless took a keen interest in the affairs of the district, and was held in the highest esteem by all who knew him. B.P.C.A. The president (Mr W. K.- Tomlinson) presided at the monthly meeting of the Oamaru Society for the Prevention of Cruelty to Animals. The delegate to the annual conference (Miss Grenfell) reported on the business transacted, and was accorded a. vote of thanks. It was decided to distribute throughout the district leaflets telling of the, cruelty associated 'with certain branches of the fur trade, , and giving a list of furs humanely produced. The Inspector reported having attended to three cases during the month —a horse (which had had to be. destroyed) and alleged cruelty to dogs and a horse. . Among the correspondence received was a report of the work done for caged birds by the Royal Society for the Prevention of Cruelty, in England, specially mentioning the work of Frances, Countess of Warwick, who takes charge of foreign birds which have ’ been rescued from wretched conditions. MANCHESTER UNITY The annual meeting of the North Otago District of Past Grands? Lodge, No. 2, was presided over by W.M.P.G. Bro. T. Jenkin. There was a good representation of members. Election of officers: —W.My Sister G. A. Abel; D.M., Bro. T. S. Finder; P.M., Bro. T. Jenkin; tyler, Bro. A. C. Kay; secretary-treasurer, Bro. W. Couper; R.S.W.M., Bro. W. Oats; L.S.W.M., Sister E. Kidd; R.S.D.M., Bro. C. E. Taylor; 8.5.D.M., Bro.. J. S. Mushet. The installation ceremony was carried out by the retiring W.M., and Bro. Mushet conferred the past master’s office on Bro. T. Jenkin. The retiring W.M. expressed his appreciation of the co-operation he had received from the members. The newlyinstalled officers addressed the meeting. . It was intimated that the next meeting would be held on May 18. It was resolved. to issue, an invitation to the Loyal Oamaru and Star of the North Lodges for a triangular card match, to be held at that meeting. The Social Committee elected comprised P.G.’s Sisters G, A- Abel, E. Abel, E. S. Kidd, and C. M. Jenkin.
