TO SEEK NEXT-OF-KIN
£BO,OOO ESTATE [Per United Press Association.] AUCKLAND, April 8. The Supreme Court was asked to take steps to ascertain' the relatives who are entitled to share in the residue of the estate of Mrs Catherine Smith, widow of Captain James Smith, of Auckland. When Mrs Smith died on August 12, 1933, her estate was valued at over £126,000, and the estimated value of the residue now to be disposed of is about £BO,OOO. When the case was before Mr Justice Callan one counsel stated that, there would be 45 relatives claiming to share in this residue. Mrs Smith’s will left the residue of the estate to charities in or about Auckland, but the Court of Appeal, and afterwards the Privy Council, held that this clause was invalid through a defect in the wording, and the residue, therefore, goes to the kinsfolk. . His Honour made an order for the registrar ho inquire who are the next-of-kin. '
