During the hearing of' evidence * faded cutting from a Sydney newspaper’ was tendered showing that Petley’* father, William, master of the Fortune, was drowned with nine others, whil# the sole survivor furnished a thrilling narrative of the sea, explaining that “ Natives appropriated a box with soma sovereigns from the captain’s chest.’* The captain’s son, Thomas Petley, died intestate. The court referred the matter to the Master in Equity.
