PEDESTRIAN KILLED IN CURIOUS CIRCUMSTANCES PROSECUTION DISMISSED [Per United Press Association.] WELLINGTON, December 16. An accident on the Hutt pipe bridge on the morning of December 1, when a motor case blown from a lorry fell on a man and killed him, had a sequel in the Petone Court to-day, when the driver of the lorry, Cecil Baden Trilford, was charged l with operating a lorry which did not have the load safely contained, in the body of the vehicle. Evidence was given that two cases, placed one on top of the other, were not roped to the lorry, which did not have raised sides. Trilford said he was depending on the weight of the cases to keep the load on the lorry, but a particularly strong gust of wind took off the top case andl the other followed. Barton Ginger, managing director of the carrying firm, said the lorry carried two full motor cases, one of which weighed 2,3001 b and the other 1,9001 b. He had never heard of a load of that weight being blown off a lorry before. The wind was so strong that the cases could not be loaded again on the bridge. After hearing other evidence the magistrate (Mr H. P. La wry) said that in his opinion the load was safely stowed within the meaning of the regulations, and the regulations were not meant to cover the extraordinary conditions of that morning. The charge would be dismissed.
